Please read these Terms of Service carefully before using the Novus MD platform or purchasing a membership subscription. By accessing novusmd.com or creating an account, you agree to be bound by these Terms.
These Terms of Service are an agreement between you and Novus MD LLC, a Delaware limited liability company ("Novus MD," "we," "us," or "our"). Novus MD LLC operates the website at novusmd.com and the membership subscription platform (collectively, the "Platform").
Novus MD LLC is not a medical provider. It is a management services organization that provides technology, administrative, and platform services. All clinical services — including medical consultations, laboratory orders, prescriptions, and ongoing clinical management — are provided exclusively by Pelerin Medical Services, PLLC (the "Practice"), a licensed professional corporation. The Practice is a separate legal entity from Novus MD LLC.
Your clinical relationship, including any patient agreement, informed consent, and Notice of Privacy Practices, is governed by separate agreements between you and the Practice. These Terms of Service govern only your use of the Platform and your subscription relationship with Novus MD LLC. Your commercial membership terms — tier selected, pricing, billing, cancellation, and refunds — are governed by your Membership Agreement, not this document.
To use the Platform and purchase a membership, you must: be at least 18 years of age; be a resident of the United States; reside in a state where the Practice is currently licensed and authorized to provide telehealth services; have the legal capacity to enter into a binding agreement; and not be prohibited from receiving our services under applicable law.
State availability. The Practice's telehealth services are currently available only to residents of Michigan and Massachusetts. See our State Availability page for the current list. If services are not available in your state, you will be notified before any charge is made.
By creating an account, you represent and warrant that you meet all eligibility requirements.
To access the Platform and purchase a membership, you must create an account. You agree to: provide accurate, current, and complete information; maintain and promptly update your account information; keep your password secure and confidential; notify us immediately at support@novusmd.com if you suspect unauthorized access; and accept responsibility for all activity under your account. Accounts are for individual use only.
Membership tiers, pricing, billing, commitment terms, auto-renewal, cancellation, and refunds are governed by your Membership Agreement, available at novusmd.com/membership-agreement, which is incorporated into these Terms by reference.
All payments are processed by Stripe, Inc. By providing a payment method, you authorize Novus MD LLC to charge that payment method for all fees due under your membership, as described in your Membership Agreement. Novus MD LLC does not store your full credit card number or CVV. If a payment fails, we will notify you and may attempt to reprocess the charge. Failure to maintain a valid payment method on file may result in suspension or termination of your account.
Novus MD LLC provides you with access to a technology platform that enables you to: create and manage a membership account; connect with the Practice for telehealth clinical services; access the patient portal and secure messaging features; and manage subscription billing and account settings.
Novus MD LLC does not provide medical advice, diagnosis, treatment, or prescriptions. Nothing on the Platform — including website content, marketing materials, educational articles, or communications from Novus MD LLC staff — constitutes medical advice or establishes a patient-physician relationship with Novus MD LLC. All clinical decisions are made exclusively by licensed clinicians employed or contracted by the Practice. The Practice retains full and independent clinical authority. Novus MD LLC has no authority to direct, override, or influence any clinical decision.
Purchasing a membership does not guarantee that you will receive a prescription for testosterone or any other medication. A licensed clinician will evaluate your individual medical history and laboratory results and will prescribe only if clinically appropriate.
The Practice's current prescribing model relies on telehealth flexibilities authorized by the Drug Enforcement Administration (DEA) through December 31, 2026. These flexibilities permit prescribing of Schedule III controlled substances via telehealth without a prior in-person examination. If the DEA does not extend these flexibilities, the Practice may require an in-person evaluation before prescribing. We will notify active subscribers of any material change to the prescribing model.
You agree not to use the Platform to: provide false or misleading information during registration or intake; attempt to obtain prescriptions through misrepresentation; access another user's account; interfere with or disrupt the Platform; scrape, copy, or reproduce Platform content without authorization; or use the Platform for any unlawful purpose. We reserve the right to suspend or terminate your account for any violation.
The Platform, including all content, design, trademarks, logos, and software, is owned by Novus MD LLC or its licensors. You may access and use the Platform for your own personal, non-commercial purposes only.
Your use of the Platform is governed by our Privacy Policy at novusmd.com/privacy, incorporated into these Terms by reference. Your protected health information is governed by the Practice's Notice of Privacy Practices, a separate document issued by Pelerin Medical Services, PLLC.
The Platform integrates with third-party services including Stripe (payment processing) and Elation Health (clinical records and telehealth platform). Your use of these services is subject to their respective terms and privacy policies.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. NOVUS MD LLC MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE CLINICAL SERVICES PROVIDED BY THE PRACTICE. CLINICAL OUTCOMES ARE NOT GUARANTEED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVUS MD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. NOVUS MD LLC'S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL MEMBERSHIP FEES PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM. Nothing in this section limits liability for fraud, gross negligence, or willful misconduct.
You agree to indemnify and hold harmless Novus MD LLC, its members, managers, officers, employees, and agents from claims, damages, losses, and expenses arising out of your use of the Platform or violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles, except as superseded by Section 14 once finalized.
We may update these Terms from time to time. We will update the "Last Updated" date and notify you by email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.
We may suspend or terminate your access at any time for violation of these Terms, non-payment, or if required by law. Sections 8, 11, 12, 13, 14, and 15 survive termination.
Entire agreement; severability; no waiver; assignment — standard provisions. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
